Author's introduction

Dear friends and readers,

Do not be deceived by an apparent simplicity and external accessibility of cultural legal information which is placed on this web site and which lies before you.

This web site seeks to give you a first, the most general review of a completely new and unique sphere of science and life, culture and law, Knowledge and Memory as applied to the European continent.

European Cultural Law has many sides and many facets and to a considerable degree it is equal in its definitions. This is a constantly developing living notion and a special sphere of European life, which is of universal and unique character, simultaneously.

It has many names and definitions which differ from each other by exceptionally different viewpoints and creative scientific approach. They all have place to be, to live and to develop. The ones that follow are only some of them.

 Preface

By the end of the 20th century in Europe de facto an integrated poly-branch and multi-level system of European Cultural Law has formed.

In theory, the European Cultural Law is a macro-complex juridical science that studies normative ties and legal relations between ideals, subjects and objects of international, national and ethnic, local and regional cultural legal systems and legislations on culture in Europe.

In practice, the European Cultural Law is a pan-European macro-legal normative system of European culture that consists of 2 parts: European Public Cultural Law and Private Cultural Law.

European Cultural Law is a complete and integral unity of legal principles and norms regulating normative ties and legal relations between ideals, subjects and objects of law related to culture, cultural property, cultural activity, cultural rights and responsibilities, values of natural and cultural heritage and cultural and natural environment in Europe as well.

European Cultural Law (ECL) is equally a science and a practice of European cultural life in normative matter.

Though this law has its roots in the times of Roman law jus cultura, it has formed, in many respects, the cultural legal image and main constants of European legal consciousness as well as manifested juridical forms of traditional legal regulation systems in Europe, its complex, doctrinal and macro-systemic scientific development falls exactly on the beginning of the 21st century and the third millennium.

European Cultural Law as a completely unique and at the same time universal system of legal regulation and world outlook, due to the aim and essence of its substantial destiny, eliminates the 'legal karma' and softens the 'legal destiny' of the European civilization.

This law opens, before all without exceptions subjects, truly finest aims, senses and perspectives in space and time, enlivens the collective memory and individual knowledge, forms an evolutionary transition from the information society towards the knowledge-based society, activates ray emission, most naturally regulates the significant normative energy and information streams, sheds light on the way of development of human, minority and community in a conventional eventful world.

Cultural legal methods and rhythmological techniques, being purposefully and expediently applied, let consciously escape natural and antropologically-caused enthropy, scientifically eliminate the reasons, first of all, of man-made and natural disasters, prevent the onset of such disasters, accidents and emergencies, soften their consequences at  macro-levels without considerable financial costs, when it is not yet late and "something can be corrected".

 

UNESCO Convention on cultural diversity is adopted

On October 20, 2005 the General Conference of UNESCO, meeting in Paris, has  approved (148 votes for, two against, four abstentions) the Convention on the protection and promotion of the diversity of cultural expressions, an international normative instrument that will enter into force three months after its ratification by 30 States. The result of a long process of maturation and two years of intense negotiations, punctuated by numerous meetings of independent and then governmental experts.

Rutilus Light - European project of the sustainable development of underwater cultural heritage in the Baltic Sea region

In Europe the fist pilot-project of the strategies for the sustainable development of the underwater cultural heritage (UCH) of the countries in the Baltic Sea region has been started.

The main objectives are the following: to establish networks, exchange knowledge and data on legislation, management, education, the content, value etc. and to develop a joint strategy for marketing and protection of the underwater cultural heritage in the region bordered by 9 nations and 2 federal states with different historical backgrounds.

On the project take part the representatives of cultural institutions, maritime museums and regional and local authorities, including the Russian scientists from the Institute of material culture and the Institute of state and law of the RAS.

The next working conference of the parties of the project took place on April 21-23, 2006 in Wismar (Germany). more information

 

EUROPEAN CULTURAL LAW as a new evolutional step towards societies, based on knowledge and memory  new

EUROPEAN CULTURAL LAW, the European international law of culture, the international cultural law of Europe - the new ecological appearance and cultural phenomena of the beginning of a new century.

The international European cultural law - the law of new century, a forerunner and precursor of the law of new millennium in Europe.

European cultural law - the law of European (cultural and ethnic) self-consciousness, cultural law (legal) identity, (cosmic) personality, ecological self-being, cultural self-determination and temporal development of nations, human beings, (inter)states and international communities.

Culture Creative Industries in Europe  

Berlin, May 3 to May 4, 2007

The conference aimed at further developing the concept of co-ordinating culture industries policies that was initiated during the Austrian Council Presidency. The requirements of culture industries policies were discussed from the perspective of the municipalities, the regions, the member states and the European Union.

The conference approaches culture industries in Europe from various angles; the point of departure is the study on culture industries in Europe commissioned by the Commission. It has focused on European culture industries in the context of global competition and on culture industries in Asia and Africa. Leading representatives of creative industries across Europe  present their perception of the situation of culture industries (www.european-creative-industries.eu).  Our future is impossible without special, pensive and unbiased comprehension of the past, which can be highlighted by a legal phenomenon - cultural heritage, on the other hand, our future is impossible without it, without patrimony embodying ties of all the times - the past, present and future - with target basis and transfer of consciousness to forthcoming performances, cultural aims and creation achievements...
